An international law based assessment of the legality of the military detention regime that Israel applies to Palestinians
Since the Hamas-led attacks of 7 October 2023 and the ensuing Israeli military offensive in Gaza, thousands of Palestinians from Gaza and the West Bank, including East Jerusalem have been taken into custody by the Israeli Security Forces.1 They have been held in different types of detention facilities run by the military or the Israel Prison Service (IPS) and pursuant to different legal regimes, but the picture emerging from a growing body of reports and testimonies indicates that Palestinians detained by Israel via these varying detention modalities have consistently been subjected to inhumane conditions of detention accompanied by systematic ill-treatment including torture and sexual violence.
